§ 1 Terms, definitions and scope of the General Terms and Conditions

1. INVENT Marketing und Tourismus GmbH, Hopfengasse 25, 4020 Linz, Austria (hereinafter referred to as INVENT) sells gift vouchers for short holidays and adventures with various organizers. INVENT brokers the services of the organizers. Urlaubsbox® is a brand of INVENT.
2. The terms used in these General Terms and Conditions have the following meanings:

• Booking code = alphanumeric code of a gift voucher which entitles the holder to redeem it during the time it is valid.
• Redeemer = person who redeems a gift voucher by giving INVENT the booking code.
• Redemption = provision of a booking code to INVENT together with a subsequent request for dates. The provision of a booking code, e.g. on the booking portals www.urlaubsbox.com/einloesen or www.invent-travel.com, alone without a subsequent request for dates does not constitute a redemption of the booking code.
• Gift voucher/voucher = general term for the vouchers for short holidays and adventures (also in an Urlaubsbox®). Includes the booking code, the period of validity and the web address for redemption.
Gift vouchers for the following product variants are currently on offer:
  
  • Short holidays with/without vouchers for hotel services
  • Short holidays with additional payment to the organizer for breakfast and dinner
  • Adventures without overnight stay
• Validity = period during which a gift voucher can be redeemed. This period begins upon full payment and ends after 3 years at the end of the respective year (31 December), calculated from the end of the year of purchase (31 December).
• Buyer = person or company who buys a gift voucher from INVENT.
• Consumption voucher = optional product supplement issued for a certain amount. Can be used in the booked hotel for all offered services; the equivalent value will be deducted from the hotel bill on departure.
• Customer = all persons interested in INVENT, Urlaubsbox®, the website and the gift vouchers – including buyers, redeemers and participants.
• Discount voucher = discount code valid for a certain amount and for a certain period for the discounted purchase of gift vouchers, usually valid above a certain order value.
• Participants = people who make use of a short holiday or an adventure.
• Urlaubsbox® = a gift box or packaged form of gift voucher (catalogue and gift voucher in high-quality box).
• Organizer = service provider (e.g. hotel, restaurant) who provides the short holiday or adventure (service) to the participants.
• Value voucher for hotel services = voucher for the hotel services mentioned in the booking confirmation, redeemable exclusively during the short holiday in the booked hotel.
• Welcome voucher = voucher issued for a certain amount, which will be deducted by the hotel for a private follow-up booking in the same hotel.

These General Terms and Conditions regulate the purchase of the gift vouchers as well as INVENT’s brokerage activities for use of the same. Deviating regulations are only valid if they have been agreed in writing between INVENT and the customer.

For the legal relations to the organizer brokered by INVENT, the organizer’s terms and conditions apply.

§ 2 Description of services

1. INVENT cooperates with a large number of organizers and combines a selection of organizers with comparable service offers for the products offered. These organizers are presented in the product descriptions on INVENT’s own websites. The service of INVENT consists of the sale of these products to the customers and the brokering of the short holidays and adventures of the organizers to the redeemers of the gift vouchers.
2. The information on the short holidays/adventures and organizers in the catalogue contained in an Urlaubsbox® refers to the time the catalogue is going to print. The cooperation between INVENT and an organizer is contractually regulated and may be subject to changes during the validity of a gift voucher, e.g. regarding the duration of the cooperation or the services offered. Therefore, organizers may be removed from the offer and new organizers may be added during the validity of a gift voucher. Information about organizers, prices, conditions, etc. may also be subject to change.
   Such changes must be accepted by the customer if the changes to the overall design of the product with regard to the description and/or selection of the organizer are reasonable, minor from the customer’s point of view and objectively justified. In the event of any further changes to the overall design, the customer is entitled to withdraw from the purchase free of charge or to select an equivalent product.
   The complete and current selection of organizers can be found on the booking portals.
3. The illustrations and photographs used on the gift vouchers, advertising materials and company websites are examples and are for general description purposes only. They are not binding and may vary.
4. INVENT does not guarantee the availability of a short holiday or experience with a specific organizer at a specific time.
5. The data stated on the gift vouchers (e.g. booking code, period of validity) entitle the holder of this data to redeem the gift voucher or to book a short holiday or adventure. The presentation of a voucher is not required at any time; it is sufficient to simply enter the voucher data.
6. The gift voucher of an Urlaubsbox® is usually activated for redemption within 24 hours after purchase/payment.

§ 3 Minors
The offer is directed exclusively at persons who possess full legal capacity and have reached the age of 18. Minors may only buy gift vouchers from INVENT with the consent of their legal representatives (usually parents).

§ 4 Retention of title and withdrawal in the event of non-payment

1. The ordered products as well as the voucher data remain the property of INVENT (retention of title) until full payment has been received.
2. If a payment that has already been made is cancelled after the gift voucher has been redeemed, INVENT can block the gift voucher and withdraw from the existing contract between the customer and the organizer on behalf of the organizer.

§ 5 Commercial resale
Any commercial resale of INVENT gift vouchers and/or discount vouchers is prohibited unless otherwise agreed in writing with INVENT.

§ 6 Period of validity and transferability

1. The gift vouchers can be redeemed within their validity period. This period begins upon full payment and ends after 3 years at the end of the respective year (31 December), calculated from the end of the year of purchase.
2. A different period of validity may apply to promotional offers.
3. Gift vouchers are freely transferable. The regulations of these General Terms and Conditions must be referred to during the transfer.

§ 7 Exchange and crediting of vouchers

1. Gift vouchers can be exchanged free of charge for other gift vouchers during their validity. The validity period of the previous voucher will be transferred to the new voucher. Gift vouchers cannot be exchanged for value vouchers; any cash redemption is excluded.
2. Any gift vouchers won in a contest and gift vouchers purchased with discount vouchers cannot be exchanged.
3. Discount vouchers cannot be used when exchanging gift vouchers.
4. Gift vouchers can be exchanged free of charge for other gift vouchers within 6 months after their expiry date. They are then valid until the end of the year in which the exchange takes place.
5. The difference must be paid when exchanging a voucher for a higher-priced product. When exchanging a voucher for a cheaper product, the difference is issued as a credit in the form of a value voucher. Any cash payment of the difference is excluded.
6. A gift voucher can only be exchanged for one other gift voucher and not for several others.

§ 8 Loss and risk of misuse

Should the voucher data be lost, stolen or at risk of misuse, the customer/owner is obliged to report this to INVENT immediately so that the voucher data can be blocked by INVENT. Due to the transferability of gift vouchers, anyone who has knowledge of the voucher data has the opportunity to redeem them. INVENT assumes no liability for unlawful redemption.

§ 10 Liability

1. INVENT does not guarantee the quality or accuracy of the data displayed online or in the catalogue of an Urlaubsbox®. In particular, the description of a short holiday or experience does not constitute a guarantee in any legal sense.
2. The contract for the short holiday or experience is concluded directly between the redeemer and the organizer. INVENT is therefore not liable for any services of the organizer that are provided deficiently, not provided at all or not provided on time.
3. The company’s own websites contain links to external third-party websites the contents of which are beyond the control of INVENT. INVENT assumes no liability for these external contents. The respective provider or operator of the pages is always responsible for the contents of the linked pages.

§ 11 Data protection
INVENT’s privacy policy provides detailed information on the type, scope and purpose of the collection, storage, processing and use of personal data. You can find our privacy policy at www.urlaubsbox.com/datenschutz.

§ 12 INVENT’s property rights
All third-party logos, pictures and graphics depicted are the property of the respective companies and are subject to the copyright of the respective licensors. Any photos, logos, texts, reports, scripts and programming routines displayed on the websites, which are proprietary developments of INVENT or have been prepared by INVENT, may not be copied or otherwise used without the consent of INVENT.

§ 13 Place of jurisdiction

1. Unless otherwise provided by law, the place of jurisdiction shall be INVENT’s registered place of business.
2. Any disputes that may arise from this legal relationship shall be governed by Austrian law to the exclusion of the rules and regulations governing conflict of laws and the UN Convention on Contracts for the International Sale of Goods.
